Stopped by police? You have the right to Remain Silent, decline roadside tests, and speak to a lawyer before answering any questions.

Have you ever been stopped by police? Did you know that you SHOULD NOT answer any questions?

You read that correctly! YOU SHOULD NOT BE SPEAKING WITH POLICE! Why? Because the government will use any answers you give to charge you with a crime.

I know, but isn't it awkward not to answer? Yes, it may be. Isn't it rude to not answer the police? No, it is your constitutional right to not speak with police until you have an attorney present.

The place I see this scenario unfolding most often are DUI stops. After reviewing hundreds of in-car police videos, here are the questions I see most often and my suggested answers.

  1. Did you see how fast you were going back there?
SUGGESTED ANSWER: "Respectfully, I decline to answer. May I leave, Officer?
  2. Did you know that you were weaving between lanes?
SUGGESTED ANSWER: "Respectfully, I decline to answer. May I leave, Officer?
  3. Did you have anything to drink tonight?
SUGGESTED ANSWER: "Respectfully, I decline to answer. May I leave, Officer?
  4. Where you coming from tonight?

  6. Do you mind if I do a quick search of your vehicle?
SUGGESTED ANSWER: "Respectfully, I decline any searches. May I leave, Officer?
  7. Do you mind performing a few tests so that I can check if you are okay to drive?

  8. If you don't answer, then I am going to have to take you back to the police station.

Again, please take note that if police are going to arrest you, answering their questions likely will NOT help you get out of it. Don't remember what to say? Screenshot this "Know Your Rights Card," and call our office in case of any legal emergencies.
